This Privacy Statement applies to TalentQuest, LLC and its subsidiaries (“TalentQuest” or “we,” “our,” or “us”). In this Privacy Statement, the words “you” and “your” refer to you, the user of our Services, as the party agreeing to this Privacy Statement.  This Privacy Statement describes our privacy practices for information that we collect from your interactions with us, including, but not limited to:

  • Use of this website and any other websites owned or controlled by us which reference or link to this Statement (the “Websites”);
  • Use of the software applications made available by us for use on or through computers and mobile devices (the “Apps”);
  • Use or consideration of our products and Services, including but not limited to, our Talent Insights™, Behavioral Assessments, Goals, Performance, Compensation, 360 Surveys, Learning, Succession, Connect, and Analytics (the “Services”);
  • Interacting with our customer service department, connecting with us on social media, posting to our social media pages, and tagging us in your social media posts (collectively, the “Communications”); and
  • Responding to or viewing our advertisements or participating in our surveys, contests, or promotions (the “Participation Opportunities”).

The Websites, the Apps, the Services, the Communications, and the Participation Opportunities are collectively referred to as the “Services.”   This Privacy Statement also applies to Personal Information that we receive from business partners or third parties (such as your Employer or potential Employer). You can find more information about our collection of Personal Information below.

This Privacy Statement does not apply to third-party websites accessible through our websites.  This Privacy Statement does not apply to any such user generated content and we are not responsible for circumvention of any privacy settings or security measures contained on the Site with respect thereto. You understand and acknowledge that, even after removal, copies of such user content may remain viewable in cached and archived pages or if other users have copied or stored your user content.

Personal Information We Collect

“Personal Information” means any data that identifies you as an individual or relates to an identifiable individual. We obtain Personal Information relating to you at various points in interacting with our Services and from various sources described below.

  1. Identifiers. We may collect identifiers, such as your first name, middle name, last name, maiden name, alias, email address, phone number, username, physical address, geolocation information, IP address, date and place of birth.
  2. Demographic Information. We may collect demographic information, such as your age, gender, and marital status.
  3. Internet Activity. We may collect internet activity information, such as your IP address, browser characteristics, device IDs and characteristics, operating system version, and referring URLs.
  4. Commercial Information. We may collect commercial information, such as Apps or Services purchased and/or used.
  5. Social Media Information. We may collect information from your social media account consistent with your settings within the social media service, such as location, check-ins, activities, interests, photos, status updates, and friend list.
  6. Payment Information. We may collect payment information, such as credit or debit card information, bank account information, and billing information.
  7. Location Information. We may collect location information, such as location based on IP address or geolocation information.
  8. Employment Information. We may collect employment information, such as employment history, current and former employer names and addresses, profession or title/role, employer/employee identification information, expense information, tax and withholding information, and emergency contact information.
  9. Audio Recordings. We may collect audio recordings, such as customer care calls.
  10. Inferences. We may collect inferences regarding your marketing and communications preferences, interests, and other characteristics.

Where We Collect Information

  • Registration on our Site: in order to use this Site, you must first create a username and password.
  • From Your Employer (or potential employer) (collectively, “Employer”) we collect your contact information (such as full name, address, phone number, and email address). We may use this information to contact you about the Services on our Site.
  • Pay for Services. We collect Personal Information from you in order to fulfill your order and your request for Services.
  • Inquire about Our Services or Request Information or Materials from Us. We collect Personal Information from you to respond to your request for a quote or inquiry about our Services.
  • Contact Customer Care Centers. We collect Personal Information from you when you contact us, including when you communicate with us by email, fax or via online chat Services or contact customer service. These verbal communications may be recorded for purposes of quality assurance and training.
  • Social Media. We collect Personal Information from you when you choose to participate in our social media activities or offerings. We may also allow you to enter into contests to provide photos which you may share with your connections on social media for votes, shared offers or other promotions.
  • Application for Employment. We collect Personal Information from you when you choose to apply online for employment with us to assess your suitability for employment.

TalentQuest is not the sole owner of the information collected on TalentQuest. Any information submitted on this Site may be shared with your Employer in connection with its use of the TalentQuest Services and/or Site.

How We Use Your Information

TalentQuest may use Personal Information provided to us as follows:

  • To offer and provide our products and Services and to support our core business functions.
  • To service or fulfill orders, including to communicate with you about our Services, send an order confirmation, register and service your account, and respond to customer service requests related to the Services we provide.
  • To personalize your experience by displaying content based upon your interests.
  • To maintain our customer relationship and provide you with information about or changes to our Websites, our Terms of Use, and/or this Privacy Statement.
  • For internal business processes, authentication, loss and fraud prevention, public safety, and legal functions.
  • For direct marketing purposes, including to invite you to participate in contests, giveaways, and promotions; to send you information about our products or service information; and to send you information about new or updated products, or news and information that you have otherwise requested through our newsletter subscription.
  • To conduct research, analysis, and advertising.
  • To invite you to participate in user surveys or to ask for your feedback on this Website or our products.
  • For internal statistical, marketing, or operational purposes, such as to measure and understand demographic, user, user interest, purchasing, and other trends among our users.
  • To protect the security and integrity of our Websites and business.
  • To investigate, prevent, defend against, or take other action regarding violations of our Privacy Statement or Terms of Use, illegal activities, suspected fraud, or situations involving potential threats to the legal rights of us or others.
  • To comply with applicable laws and regulations.

TalentQuest may collect information about the use of the Site, such as the types of Services used and how many users we receive daily. This information is collected in aggregate form, without identifying any user individually. TalentQuest may use this aggregate, non-identifying statistical data for statistical analysis, research, marketing, or similar promotional purposes. In addition, TalentQuest analyzes aggregate data as part of ongoing efforts to validate and enhance our product.

Communications From The Site

  • Service-related Announcements – We will send you service-related announcements on occasions when it is necessary to do so. For instance, if you are a participant in a performance appraisal or a 360-feedback survey, we will send you a notification email. In some instances, we may also send you other notification/reminder emails related to the performance management process. Generally, you may not opt-out of these communications, which are not promotional in nature. You may opt out of the 360-feedback process and the emails related to that 360-feedback process by following the opt-out procedure specified in such e-mail. If you do not wish to receive any emails, your Employer has the option to deactivate your account.
  • Customer Service – We will communicate with you in response to your inquiries, to provide the Services you request, and to manage your account. We will communicate with you by email or telephone, in accordance with your reasonable instructions.

How We Disclose Your Personal Information

We may disclose Personal Information provided to us as follows:

  • Aggregate Information (non-personally identifiable) – We may disclose aggregate data for validity, reliability, and normative research, though in such analyses data will not be identified by individual.
  • Personally Identifiable Information – We DO NOT share Personally Identifiable Information with third parties, except as described in this Privacy Statement. We may disclose information that you provide with your Employer. We may also share personally identifiable information with companies providing Services to us or delivering Services on our behalf.  This includes the provision of certain Services available through our website, like the vendors we partner with that perform behavioral and personality assessments. In such cases, we require these companies to institute safeguards for the protection of your information.
  • Acquisition – If our company or our assets are acquired by another company, the acquiring company will assume responsibility for the information collected by us through this web site and it will assume the rights and obligations regarding the information collected through this web site, as described in this Privacy Statement.
  • Required by Law We will disclose your personally identifiable information (i) if we are required to do so by law or legal process, (ii) to law enforcement authorities or other government officials based on an enforceable government request or as may be required under applicable law, or (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity.

Links To Other Sites

Our Websites may contain third-party links, include third-party integrations, or offer a co-branded or third-party branded service (collectively, “Other Links and Sites”). Through these Other Links and Sites, you may be providing information (including Personal Information and other information) directly to the third party (which may include certain Service Providers), us, or both. Because these Other Links and Sites may not be hosted or controlled by us,  we are not responsible for the privacy practices of those Other Links and Sites or the content provided thereon.

This Privacy Policy does not apply to the information practices of those Other Links and Sites. We encourage you to review the privacy policies of each of those Other Links and Sites carefully.

Choice/Opt-out

Participation in the Services offered on our Site (e.g., performance appraisals, goals management, 360 feedback, selection assessments, succession planning, learning management, connect, compensation management, and any future Services we may offer) is based on your relationship with your Employer.  If you decide not to participate that should be discussed with your employer.

For marketing messages, you may unsubscribe from our newsletter by clicking on the unsubscribe button found in the emails at any time.

Log Files

As is true of most web sites, we gather certain information automatically and store it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data.

We use this information to analyze trends, to administer the Site, to provide support, to track users’ movements around the Site and to gather demographic information about our user base as a whole.

We do not link this automatically collected data to personally identifiable information.
We use cookies as session identifiers on our servers.

Cookies

A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. We use cookies on our Site. When visiting our Site we maintain data on the user’s activities on our servers within a session. This session is uniquely identifiable via a temporary session token. We store this session token in the session cookie.

A session ID cookie expires when you close your browser, and does not contain any personally identifiable information. A persistent cookie remains on your hard drive for an extended period of time. We set a persistent cookie to store your login id, so you don’t have to enter it more than once.

Some Internet browsers have begun to offer what often is referred to as “do not track” mechanisms for browser users to automatically signal privacy preferences to websites that they visit. This PRIVACY STATEMENT FOR CALIFORNIA RESIDENTS supplements the information contained in the Privacy Statement above and applies solely to visitors, users, and others who reside in the State of California (“consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and other California privacy laws. Any terms defined in the CCPA have the same meaning when used in this notice.

We obtain the categories of Personal Information listed above from the following categories of sources:

  • Directly and indirectly from our clients or their agents.
  • Directly and indirectly from consumers. For example, through information we collect from our clients while providing Services to them.
  • Directly and indirectly from activity on our websites. For example, from submissions through our website portal or website usage details collected automatically.
  • From third parties that interact with us in connection with the Services we perform.

Use of Personal Information

We may use or disclose the personal information we collect for one or more of the following business purposes:

  • To fulfill or meet the reason for which the information is provided.
  • To provide you with information, products or Services that you request from us.
  • To provide you with email alerts, event registrations and other notices concerning our products or Services, or events or news, that may be of interest to you.
  • To carry out our obligations and enforce our rights arising from any contracts entered between you and us, including for billing and collections.
  • To improve our website and present its contents to you.
  • For testing, research, analysis and product development.
  • As necessary or appropriate to protect the rights, property or safety of us, our clients or others.
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.

We will not collect additional categories of Personal Information or use the Personal Information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

Sharing Personal Information

We may disclose your Personal Information to a third party for a business purpose. When we disclose Personal Information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that Personal Information confidential and not use it for any purpose except performing the contract.

In the last 12 months, we have disclosed the following categories of Personal Information for a business purpose:

Category A: Identifiers. Category B: California Customer Records Personal Information categories. Category C: Protected classification characteristics under California or federal law. Category I: Professional or employment-related information.

We disclose your Personal Information for a business purpose to the following categories of third parties:

  • Our affiliates.
  • Service providers.
  • Employers/Third parties to whom you authorize us to disclose your Personal Information in connection with products or Services we provide.

In the last 12 months, we have not sold any Personal Information.  We have shared Personal Information with your Employer and our Service Providers as described above. Please note that the CCPA defines sale broadly; thus, for example, the fact that we use analytics tools on our websites may be considered a sale under current California law. As a result, even when we do not get paid for the information and the recipient uses the information for its own purposes, the mere disclosure of the Personal Information to the recipient may be considered a sale under the CCPA.

Your Privacy Rights

You have the following rights under the CCPA:

Access to Information and Data Portability Rights

You have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of Personal Information we collected about you.
  • The categories of sources for the Personal Information we collected about you.
  • Our business or commercial purpose for collecting or selling that Personal Information.
  • The categories of third parties with whom we share that Personal Information.
  • The specific pieces of Personal Information we collected about you (also called a data portability request).
  • If we sold or disclosed your Personal Information for a business purpose, two separate lists disclosing:
    • sales, identifying the Personal Information categories that each category of recipient purchased; and
    • disclosures for a business purpose, identifying the Personal Information categories that each category of recipient obtained.

Deletion Request Rights

You have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies.

Exercising Access, Data Portability, and Deletion Rights
To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either:

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child, to the limited extent we have information related to minors. we will confirm receipt of the request within 10 business days describing our verification process. We will respond to your request within 45 calendar days if we are able to verify your identity. Requests for deletion will require a separate confirmation that you want your information deleted.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format
We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or Services.
  • Charge you different prices or rates for goods or Services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or Services.
  • Suggest that you may receive a different price or rate for goods or Services or a different level or quality of goods or Services.

Access To Personally Identifiable Information

If your personally identifiable information changes, you may update it by making the change on your personal profile page or by emailing your company administrator. You may access your profile page by clicking the profile link on the TalentQuest Home Page.

Access to Talent and Performance Management related data stored by TalentQuest (such as assessments or 360 feedback reports) is provided at the discretion of your Employer.

Security

The security of your personally identifiable information is important to us. When you enter information, we encrypt that information using secure socket layer technology (SSL). (To learn more about SSL, follow this link http://www.verisign.com/ssl/ssl-information-center/how-ssl-security-works/)

We follow generally accepted industry standards to protect the personally identifiable information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

Our Websites And Children

Our Websites and Apps are not created for children or designed to solicit information from individuals under the age of 18. We do not knowingly collect or store any personal information from anyone under the age of 18. If we become aware that we have collected or stored personal information from an individual under age 18, we will remove his or her personal information from our files. If you are a parent or guardian and believe we may have inadvertently collected personal information from your child, please notify us immediately by sending an email to privacyofficer@talentquest.com.

International Data Transfers

We operate internationally, and as a result, may transfer Personal Information across international borders, including from the EEA and Canada to the United States for processing and storage and India for processing depending on the Services you access. Information collected through this website may be delivered to servers located in the United States and Canada. By using our Site, you consent to the transfer of this data, and to our use of such data as outlined in this Privacy Statement; provided, however, if you are located in the European Economic Area, please visit our EU-US Privacy Shield Privacy Statement to learn about your rights with respect to Personal Information.

On July 16, 2020, the European Court of Justice invalidated Privacy Shield as a Transfer Mechanism for data between EU and US companies.  Even though Privacy Shield was invalidated, TalentQuest will continue to honor its commitments with respect to EU personal data transferred pursuant to Privacy Shield before July 16, 2020.  TalentQuest intends to utilize alternate transfer mechanisms going forward for data transfers.

EU Data Subjects

This section applies if you are an EU data subject (for these purposes, reference to the EU also includes the United Kingdom, and the European Economic Area countries of Iceland, Liechtenstein and Norway and, where applicable, Switzerland). TalentQuest is the data controller for processing Personal Data provided to TalentQuest in relation to the Sites and Services. Unless you have given us your consent for our independent uses of your Personal Data or we have another lawful basis for processing your Personal Data, we act strictly as a data processor for Personal Data that we process through the Services, as described in the “Personal Information We Collect Automatically From Your Use of the Services” section above. We rely on the following legal basis for processing your Personal Data:

  • Processing of your Personal Data based on your consent for such processing. You have the right to withdraw your consent, as further described below.
  • Processing of your Personal Data that you provide to us when you register for the Service or when you otherwise send inquiries about our Service and processing of this data is necessary to respond to or implement your request prior to entering into a contract with us or a data controller that is using our Services.
  • We use account-related data to set up accounts for users in the Service and to administer and support those accounts (such as usernames, email address and billing information), provide you with access to the Service, contact you regarding your use of the Services or to notify you of important changes to the Service. Such use is necessary for the performance of the contract between you and us.
  • We may send you information by email or through other electronic communications on our new products or services or other promotions if you consent to receiving them. If you have not opted-in to these marketing emails, we do this either because we are relying on an exception to opt-in requirements or because of our legitimate interest to promote the success of our business.
  • Our use of data relating to your use of the Site and/or the Service, described above, is necessary for our legitimate interests in understanding how the Site and the Service are being used by you, to improve your experience on it and our Service offerings.
  • We also have a legitimate interest in aggregating and/or anonymizing or de-identifying the information that we collect through our Site and/or the Service and using this information for our business purposes, as described above.
  • When we process your Personal Data for our legitimate interests, we make sure to consider and balance any potential impact on you, and your rights under data protection laws. Our legitimate business interests do not automatically override your interests – we will not use your Personal Data for activities where our interests are overridden by the impact on you, unless we have your consent for our processing activities or those activities are otherwise required or permitted by law. You have the right to object to processing that is based on our legitimate interests, as further described below.

Right of access

If you ask us, we will confirm whether we are processing your Personal Information and, if so, provide you with a copy of that Personal Information (along with certain other details). If you require additional copies, we may need to charge a reasonable fee.

Right to rectification

If your Personal Information that we control is inaccurate or incomplete, you are entitled to have it rectified or completed. Note that we may not be able to rectify information obtained from a third party such as a governmental agency or other data that we do not control, and you will need to contact that third party directly. If we have shared your Personal Information with others, we will tell them about the rectification where possible. If you ask us, where possible and lawful to do so, we will also tell you with whom we shared your Personal Information so that you can contact them directly.

Right to erasure

You may ask us to delete or remove your Personal Information and we will do so in some circumstances, such as where we no longer need it (we may not delete your information when other interests outweigh your right to deletion, for example if we are required by law to keep it). If we have shared your information with others, we will tell them about the erasure where possible. If you ask us, where possible and lawful to do so, we will also tell you with whom we shared your Personal Information so that you can contact them directly.

Right to restrict processing

You may ask us to restrict or ‘block’ the processing of your Personal Information in certain circumstances, such as where you contest the accuracy of that Personal Information or object to us processing it. Right to data portability

Effective 25 May 2018, you have the right to obtain your Personal Information from us that you consented to give us or that is necessary to perform a contract with you, to the extent it is available. We will give you your Personal Information in a structured, commonly used and machine-readable format.

Right to object

You may ask us at any time to stop processing your Personal Information, and we will do so if we are processing your Personal Information for the Service, for direct marketing, or otherwise. However, if we are relying on a legitimate interest to process your Personal Information and we demonstrate compelling legitimate grounds for the processing we may continue; or you may exercise your rights by contacting us as indicated under “Contact Us”. Note you will be asked to verify your identity when submitting a request.

Rights in relation to automated decision-making and profiling

You have the right to be free from decisions that we make based solely on automated processing of your Personal Information, including profiling, which produce a significant legal effect on you, unless such profiling is necessary for entering into, or the performance of, a contract between you and us, or with your explicit consent.

Right to withdraw consent

If we rely on your consent to process your Personal Information, you have the right to withdraw that consent at any time. Your withdrawal of consent will not apply to or affect prior processing of data that was processed prior to our receipt of your withdrawal of consent.

Right to lodge a complaint with the data protection authority

If you have a concern about our privacy practices, including the way we have handled your Personal Information, you can report it to the data protection authority that is authorized to hear those concerns.

If you have an account with us, we may instruct you to exercise some of your rights above through account settings or features, or by deleting your account.
